Pregnant-Woman Reacts to a Cop that Stomp Her Stomach

A woman named Emerald Black is suing the Californian city of San Leandro after an alleged June 7, 2019 attack by cops that she claims caused her to miscarry. Her attorneys filed a lawsuit against the town and its police on Monday.

According to the lawsuit, on the date it happened, Black was just discharged from the hospital for a pregnancy investigation which proved that she was at high danger for a miscarriage.

After the exam, Black, still wearing “hospital clothing,” was a passenger during a car driven by her fiancée. When police pulled her fiancée over for having expired registration tags, Black informed officers she was pregnant and she or he was asked to stay within the car when police had a conversation with her fiancée outside of the car.

Then, police allegedly yanked Black from the car, “taunted her, piled on top of her and stomped on her stomach leaving a shoe mark,” consistent with the court filing.

The attack caused Black to miscarry, she says. Now she filed a lawsuit for injuries inflicted on her body, assault, brutality and emotional distress from both the incident and miscarriage.

The lawsuit asserts that police defiled Black’s constitutional rights under the Fourth Amendment which restrict excessive pressure and unlawful restrictions since Black was allegedly not armed, non-combative and had defaulted no offence.

“Defendants had no proof or maybe reasonable witness to use any pressure whatsoever against Plaintiff. Therefore, the application of any pressure, was against the law and excessive.”

Black’s lawyer also asserts that the officers defiled the state’s Bane Act which protects citizens from any dehumanization that interferes with the rights of the citizens. Finally, lawyers accused police of false arrest and detainment.

This is not the first time police are accused of mishandling a pregnant woman.

In May 2019, a Texas policeman shot and killed a lady during an arrest after she shouted, “I’m pregnant.” the lady had allegedly tried to grab the officer’s taser to use it against him.

In July 2019, NY City paid a $610,000 settlement to a lady who was shackled and handcuffed by police minutes before parturition. Shackling pregnant prisoners during labor has been banned in NY state since 2009.

In July 2018, North Miami Beach policeman Ambar Pacheco was arrested after she allegedly kicked Evoni Murray, a pregnant woman, within the stomach. The woman was rushed to the hospital and gave birth to a healthy child. Pacheco was later charged with aggravated battery.
